Terms of Service
These Terms of Service constitute a legally binding agreement between you and Archaic Motor Company Ltd. Please read them carefully before using our website or placing an order. By accessing our website or making a purchase, you confirm that you have read, understood, and agree to be bound by these terms.
1. About Us
Archaic Motor Company Ltd ("A.M.Co", "we", "us", or "our") is a company registered in England and Wales.
- Registered company name: Archaic Motor Company Ltd
- Company registration number: 16600619
- Registered address: 34-35 Hatton Garden, London, EC1N 8DX, United Kingdom
- Trading address: As above
- Email: support@am-clothing-co.com
Our website is operated on the WooCommerce platform. References to the "Services" throughout these Terms include our website, online store, and any related tools or features.
2. Acceptance of Terms
By visiting our website or placing an order, you confirm that:
- You are at least 18 years of age;
- You have the legal capacity to enter into a binding contract;
- You are not purchasing goods for the purpose of resale without our prior written consent; and
- The information you provide to us is accurate and complete.
We reserve the right to update these Terms at any time. The version in force at the time you place your order is the version that applies to that order. Material changes will be communicated via a notice on our website or by email where possible.
3. Your Statutory Rights
Nothing in these Terms removes, limits, or affects your statutory rights as a consumer under UK law. Your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are fully preserved.
If there is any conflict between these Terms and your statutory rights, your statutory rights prevail. You always have the right to receive goods that are of satisfactory quality, fit for purpose, and as described.
4. Products and Our Made-to-Order Process
4.1 Made-to-Order
All products sold by A.M.Co are made to order. This means that each item is created specifically for you at the time of purchase. We do not hold a warehouse of pre-made stock. This process reduces textile waste and allows us to offer unique designs.
As a result of our made-to-order model:
- Production and dispatch times may be longer than standard retail. Estimated timeframes are stated on each product page and at checkout.
- Orders cannot be amended or cancelled once production has begun. Please review your order carefully before completing checkout.
- Our returns policy differs from standard retail — please review Section 9 carefully before purchasing.
4.2 Product Descriptions and Images
We take care to ensure that product descriptions, sizing information, and images are accurate. However:
- Colours displayed on screen may vary slightly from the physical product due to differences in device displays and print processes.
- Product images are representative. Minor variations in print placement or colour tone are inherent to the made-to-order process and do not constitute a defect.
- Sizing measurements are provided as a guide. We strongly recommend consulting the Size Guide on each product page before ordering. Fit descriptions (e.g. oversized, slim fit) are approximate.
If a product is materially different from its description, your rights under Section 9 (refunds and return policy) apply.
4.3 Availability
All products are subject to availability. In the rare event that a product becomes unavailable after you have placed an order, we will notify you promptly and offer a full refund.
5. Ordering and Contract Formation
Placing an order on our website constitutes an offer to purchase. A binding contract between you and A.M.Co is formed when we send you an order confirmation email. Acknowledgement of receipt of your order does not itself constitute acceptance.
We reserve the right to decline or cancel any order at our discretion, including where:
- A product is listed at an incorrect price due to a typographical or technical error;
- We are unable to verify payment or suspect fraudulent activity;
- The order cannot be fulfilled due to circumstances outside our control; or
- The order violates these Terms.
Where we cancel an order you have already paid for, we will issue a full refund to your original payment method within 14 calendar days.
6. Pricing and Payment
- All prices are displayed in pounds sterling (GBP).
- Prices exclude VAT.
- We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you complete checkout.
- Payment is taken in full at the time of order.
- We accept the following payment methods: [list accepted methods, e.g. Visa, Mastercard, American Express, Apple Pay, Google Pay, PayPal].
- If your payment is declined or fails, your order will not be processed. We will notify you so you can attempt payment again.
- We use third-party payment processors to handle transactions securely. We do not store your full card details.
7. Shipping and Delivery
7.1 Dispatch and Delivery Timeframes
Estimated production and dispatch times are stated on product pages and at checkout. Delivery timeframes are estimates provided by our carrier and are not guaranteed. We are not liable for delays caused by the carrier once your order has been dispatched.
7.2 Shipping Costs
Shipping costs are calculated at checkout based on your delivery address and order weight. Any applicable import duties or taxes for international orders are the customer's responsibility.
7.3 Risk and Ownership
Risk in the goods passes to you upon delivery. Until delivery is confirmed, we bear the risk of loss or damage during transit. Title to the goods passes to you upon receipt of full payment.
7.4 Failed Deliveries and Incorrect Addresses
You are responsible for providing an accurate and complete delivery address at the time of ordering. If a delivery fails due to an incorrect address provided by you, or because you failed to collect the parcel, we are not liable for the loss. Any costs associated with reshipping or replacement orders will be your responsibility.
7.5 Lost Parcels
If your tracking has shown no update for more than 10 business days beyond the estimated delivery date, please contact us at support@am-clothing-co.com. Claims for lost parcels must be submitted within 30 days of the estimated delivery date. We will liaise with the carrier on your behalf and, if the parcel is confirmed lost, provide a replacement or refund.
7.6 Force Majeure — Shipping Delays
We are not responsible for shipping delays caused by events outside our or the carrier's reasonable control, including adverse weather, industrial action, customs delays, or national emergencies. We will keep you informed where such delays affect your order.
8. Order Cancellations
Because our products are made to order, production begins promptly after your order is confirmed. As a result, we are generally unable to accept cancellations once production has commenced.
Under the Consumer Contracts Regulations 2013, consumers ordinarily have a 14-day right to cancel distance purchases. However, this right does not apply to goods that are made to the consumer's specifications or are clearly personalised. As our products are made to order specifically for you, this exemption may apply.
If you wish to cancel an order and production has not yet begun, please contact us immediately at support@am-clothing-co.com. We will do our best to accommodate your request. If we are able to cancel before production starts, a full refund will be issued within 14 calendar days.
9. Returns and Refunds
Our full Returns and Refunds Policy is available at [INSERT LINK]. It forms part of these Terms and should be read alongside them. Key points are summarised below:
- We accept claims for items that arrive damaged, defective, or materially different from their description. Please contact us within 30 days of delivery.
- Because products are made to order, we do not accept returns for change of mind or incorrect size selection. Please consult our Size Guide before ordering.
- Where a valid claim is made, we will offer a free replacement or full refund. We do not require the item to be returned in most circumstances — we may request photographic evidence of the issue.
- Refunds are processed to your original payment method within 14 calendar days of approval.
Nothing in this section affects your rights under the Consumer Rights Act 2015.

The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr, though this primarily applies to EU-based consumers.
These Terms are governed by the laws of England and Wales. Any disputes that cannot be resolved by agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Force Majeure
We shall not be in breach of these Terms or liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control. This includes but is not limited to: acts of God, natural disasters, pandemics, fire, flood, war, terrorism, industrial disputes, supply chain disruptions, or failures of third-party service providers (including our fulfilment partner or carriers).
Where a force majeure event affects our ability to fulfil an order, we will notify you as soon as reasonably practicable and, where the delay exceeds 30 days, offer you the option to cancel your order and receive a full refund.
15. Privacy and Data Protection
Your use of our website and purchase of products is also governed by our Privacy Policy, available at [INSERT LINK]. Our Privacy Policy explains how we collect, use, and protect your personal information in accordance with UK GDPR and the Data Protection Act 2018.
Archaic Motor Company Ltd is registered as a data controller with the Information Commissioner's Office (ICO) under registration number [INSERT ICO REGISTRATION NUMBER].
16. General
- Severability: If any provision of these Terms is found to be unlawful or unenforceable, it shall be severed from the remaining Terms, which shall continue in full force and effect.
- Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
- Entire Agreement: These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and A.M.Co in relation to your use of our website and purchase of products.
- Third Party Rights: Nothing in these Terms confers any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
